Updates to Colorado FAMLI Program Notice

Colorado has updated the required Family and Medical Leave Insurance (FAMLI) Program Notice. Employers should immediately replace any older versions currently in use and review their posting and delivery practices to ensure compliance with Colorado’s FAMLI notification requirements. Below is a brief refresher on employer notice obligations.

FAMLI notice requirements

  • New hire notice
     Employers must provide the official FAMLI Program Notice to every new employee. Internal summaries, handbook language or substitute documents do not satisfy this requirement.
  • Workplace posting
     The Program Notice must be posted in a prominent location where employees can easily see it. Employers must post the notice in English, Spanish and any additional language spoken by at least 5% of the workforce.
  • Remote workforce delivery
     Employers without a physical worksite, or with remote employees, must provide the notice electronically, such as by email or by posting it prominently on an intranet or workforce communication platform.
  • Individual notice after qualifying events
    When an employer becomes aware of a potential FAMLI‑qualifying event (e.g., birth of a child or serious health condition), the Program Notice must be provided to the employee within five days.
  • Private Plan employers
     Employers with an approved Private Plan must use notices that include plan‑specific details, such as benefits, eligibility, contributions and appeal rights. These notices must also be individually delivered following qualifying events.

Employers with Colorado employees should consider the following steps:

  • Replace older postings with the updated required FAMLI Program Notice across all physical and electronic locations
  • Confirm onboarding workflows include delivery of the official notice to all new hires
  • Validate required language coverage
  • Confirm Private Plan notices include all required plan‑specific content
